1031 Exchange ? The Most Common Mistakes!

A property transaction related to a 1031 exchange into a Tenant in Common property could have a great impact on the financial stability of a person. Any mistake or a wrong decision in regards to a 1031 exchange can put you in deep trouble, besides unexpected financial liabilities.

It is often seen that most people interested for a 1031 exchange into a Tenant in Common property commit certain basic mistakes that jeopardize the whole transaction or results in a complicated legal situation leading to the client paying a huge tax or penalty amount.

Before I tell you about these common mistakes, let me first explain in brief what is 1031 exchange and how it helps.

Section 1031 of the IRC gives a chance to real estate buyers to defer the capital gain taxes that they incur by selling a property. It states, a real property owner can sell his property and then reinvest the proceeds to purchase of like-kind property and defer the capital gain taxes. Like-kind exchange is considered as one of the best-kept secrets of the Internal Revenue Code and very few CPAs, lawyers and financial advisors have proper knowledge about this.

Also check the properties available with them, a good investment property would only pick the best properties ? good real estate properties are hard to find and sells fast. While mediocre or small investment companies will deal with B grade or less desirable properties, the good investment firms will have only the best properties on offer.

If you are planning to do it privately, be cautious about getting into a Limited Partnership where only one or two members make all the decisions. Another alternative to could be to get a group of friends together and do it all by yourself, however, that is feasible only if you have extensive experience with commercial property and property management.

b) Choose a well-experienced qualified intermediary. A qualified intermediary is extremely instrumental in the successful completion of a 1031 exchange for Tenants in common property. They need to be well conversant with 1031 exchange rules. They ensure that all documentation and money transfer meets the guidelines set for the by section 1031 of the IRS.

Your Accommodators will set up your LLC. It is suggested that you should not work with an accommodator with whom you have an existing relationship. Your family attorney or estate planning attorney may not qualify as your accommodator. A small mistake here can lead to a hefty bill for taxes or penalties by the IRS, or even worse, the whole transaction might fail due to the incompetence of your accommodator or qualified intermediary.

c) Don?t try to cut corners on your property management company. This is extremely important for profitable performance of your investment. You will have to depend on your property management company for the day-to-day problems that will arise; they will be responsible for paying your property taxes in time and maintaining your building. Your property management company should be able to offer you a long term Triple Net Lease that has detailing of your annual income percentage along with scheduled increase. Only reputable management companies would be in a position to offer this. It is worth spending on a good property management company as you get a much higher return on your investment with them compared to any startup. Property Renovations: Part 2 More Focus Areas

In Part One of our discussion, we focused on several aspects of home renovation that are important for success in your investment. Last time, we focused on more of the smaller details - the garden, repairing and touching-up minor damages, fences, etc. Now, we should focus on some of the more noticeable areas of property renovations.

It?s very important to check for any electrical or plumbing problems before you start doing any painting on the interior of the home. This way, you won?t run into any problems down the road with re-painting if any damage occurs.

Painting your interior is important stuff - you?d be surprised at the degree that paint affects the selling price. The key is to do your math first; if you feel like painting yourself would save enough money and could be in done in an adequate amount of time, you should use the do-it-yourself approach. However, if you are inexperienced and are unable to devote enough time and effort into the project, letting a professional do the job is probably the safest route.

When approaching the paint job, keep in mind the K.I.S.S. principle: Keep It Simple, Stupid! Don?t let your personal preferences affect the way you go about your property renovations. The following are some basic painting rules you should follow:

1. Always prepare surfaces prior to painting. Be sure to wash down walls, and repair any cracks or holes, and sand, where needed. Bathrooms and kitchens are the most susceptible to grime and mold, so pay close attention.

2. Use one color. It saves you time and money. Gloss paint usually appears darker, providing slight contrast. The condition of the trims should determine the use of gloss or semi-gloss. Remember, as well, that gloss tends to highlight imperfections.

3. Make a trip to the paint store and browse the newest colors. Feature walls are an effective way to add some pizzazz to your paint job. Dark, small rooms and dark paint do not mix; this only enhances the problem.

4. If there are darker colors or wall stains, you should use a special sealer. If you don?t, and you apply extra coats of paint, the walls will remain stained.

The kitchen, for many homeowners, is the center of attention. Kitchen remodeling, however, can get pricey, so you may want to stick to changing minor features on the property. Sometimes a quick facelift isn?t enough. On some occasions, a kitchen may need to be fully replaced. If this happens, remember the K.I.S.S. approach, and don?t go overboard. Many suppliers offer kitchen kits which are ready to assemble; these can help save loads of time if you come across them. Keep the kitchen light and bright, with cheerful curtains.

Make sure all appliances are in working order, and only replace if it is unavoidable. Install a durable floor, and test all faucets, to ensure that water pressure is adequate. If you run across second-hand items in good condition, make use of them.

Housing Slide Affects Lenders

The slowdown in the US housing market is leaving many of America's largest mortgage lenders to adapt new business plans.

Many lenders are cutting costs and launching new risk reduction strategies in the face of a slowing market in the $9 trillion home mortgage industry.

Slowing sales have pushed inventories of unsold homes up 39% in the past year. Many areas are seeing slower rates of home price appreciation, with a few reporting depreciation of home prices. Builders recently reported the lowest confidence in the past 14 years for the month of July.

I've never seen a soft-landing in 53 years, so we have a ways to go before this levels out, Countrywide CEO Angelo Mozilo said. Countrywide recently announced plans to cut costs. I have prepared the company for the worst that can happen.

Countrywide plans to cut as much as $500 million in costs over the next year, partly due to the slowing market.

Ameriquest Mortgage Company, the nation's largest subprime lender, announced earlier in the year that it will cut over a third of its 11,000 employees. Washington Mutual is also in the process of cutting mortgage-related employees.

Many lenders are tightening down, yet some are looking at this as an opportunity to expand. Many larger lenders are purchasing smaller mortgage companies. Others are exploring more lucrative mortgage products, such as payment-option ARMs.

SEAT at Techno Classica Essen

SEAT, Volkswagen Group's Spanish automotive brand has showcased some of their most popular and classical vehicle models at the concurrent Techno Classica Essen in Germany.

Techno Classica Essen is one of the largest classic automotive shows in the world for veteran cars, vintage cars, and classic cars from different automakers. Moreover, also included in the Techno Classica are auto parts and accessories show, forum for manufacturers and clubs, and market for tools, clothing, model cars and others. Last year, more than 150,000 visitors from more than 30 countries participated in the show that took place at Essen, Germany. Over 1,000 exhibitors comprised of 15 domestic and international manufacturers have presented their products at the 110,000 square meters, 17 halls of exhibition space.

For the third time, SEAT has participated in the 19th edition of the Techno Classica Essen, presenting four of their most popular models including classic cars, concept, and production models. Leading the product lineup is the legendary SEAT 600, along with the SEAT 850 Sport Spider, which has dominated the European market in their time. In addition, SEAT has also showcased the Toledo Marathon and the SEAT Formula concept car at the show.

The SEAT 600, built from 1957 to 1973 is popular for initiating a massive production of vehicles in Spain that helped the country to recover economically after the Spanish Civil War. SEAT will display one of the last units of SEAT 600 produced in Barcelona in 1973. Another classic model, a 1969 SEAT 850 Sport Spider with a 903 cc engine that pumps out 52 horsepower is presented at the Techno Classica Essen. According to the Spanish automaker, the SEAT 850 Sport Spider made history as the first sporty convertible vehicle model sold in the Spanish market during the 60s 70s.

Meanwhile, the SEAT Toledo Marathon embodies the SEAT's ingenuity in building models that stand out for their popularity and great success in motor sports. The SEAT Toledo Marathon was built in 1992 by SEAT Sport and competed in some of the European and international off-road rally racing events and gave the Spanish automotive brand some great victories including the Greece Raid in 1993.

Last but definitely not the least is the spectacular SEAT Formula concept car. Unveiled in 1999, the 2-seater convertible concept car features a 2.0-liter 4-cylinder 20 valve turbo engine capable of pumping out 240 horsepower, coupled with a 6-speed transmission with sequential gearbox taken from SEAT Cordoba World Rally Car. Performance is at 5 seconds acceleration time from 0 to 60 mph, reaching a top speed of 146 mph. The SEAT Formula is most probably equipped with VW strut mount. Nursing in Crisis: How Hospitals are Dealing with the Shortage


The Current State of Nursing


Healthcare delivery has undergone critical change over the last several years, and the nursing profession has changed along with it. The end result: A reduction in the supply of qualified, experienced nurses. Those who remain are working under conditions of heavier case loads, technological complexity and increased acuity of patients. A condition which once warranted a lengthy in-patient stay is now treated on an out-patient basis, largely because of managed care requirements.


According to Debbie Pickup, Director of Human Resources at Southcoast Healthcare System and a former R.N., The nurse's role of patient care is the same, but the importance has escalated. Since hospital stays are shorter, a patient who undergoes surgery used to stay for one week, but now only stays two to three days. Nurses must assist the patient to bring him or her to a functioning level and put together a plan to support the patient and assure quality care, while discharging sooner. According to Barbara Munro, Dean of Nursing at Boston College, Nurses have said that the problem has been the working conditions - too few nurses, not enough support, an uncertain future, and forced overtime.


The role of patient families has also changed in the last decade. Both patients and their families are more educated and involved in the process, according to David DeJesus, Vice President of Human Resources at Southcoast Healthcare System. Families used to trust the care of the patient to physicians and nurses; now it's common that family members stay 24 hours a day, ask questions about the care, and put more demands on the nurses.


Reasons for the Shortage


The current shortage in qualified, experienced nurses is not expected to improve over the next several years. In fact, the majority of senior level nurses and nurse managers are reaching retirement age. As they exit the profession, fewer nurses will be available or willing to assume a management role. The current climate of understaffing, 24-hour shifts, increased management responsibility, and increased acuity of patients often leaves younger nurses reluctant to fill the gap.


Dean Munro sees the problem continuing. Most nurses are around 45 years old, white, suburban women, 80% of whom are currently working full-time. As they retire, they often leave because they're burnt out; unfortunately, there are simply not enough nurses to replace them.


Only a few years ago, industry analysts were stating that there was an over supply of nurses - not so anymore. Why aren't there enough nurses to replace those who are retiring or leaving the profession? Hiring managers are finding that younger Baby Boomers and Generation Xers are no longer viewing nursing as a viable profession because of the difficult work environment combined with a desire for more control, quality and balance in their lives. In addition, women have more choices of fields to enter. As one 20-year nursing veteran put it, There are simply more options open to bright women interested in healthcare; before there was only nursing - now there is 'medicine'. I recently took my daughter to work one day, but frankly, I'm not encouraging her to become a nurse. The working conditions are horrendous, the responsibility is huge, patients are acute, and the workload index is high.


According to Dean Munro, the national level of enrollment for nursing is down, although applicants to Boston College have risen. Of 20,000 applicants, only the upper echelon (about 2,000) is accepted. Boston College, Yale, and other academic institutions are forming accelerated programs to attract those who wish to change careers. Accelerated programs enroll people who already hold bachelor's degrees in other fields into a one-year intensive nursing program or a two-year master's program. The average age range for program applicants is 25 to 35 years old.


Debbie Pickup from Southcoast Healthcare System witnessed an increase in the average age of incoming nurses. The age of new nurses used to be around 21 or 22; now graduates have varied ages, often in the mid-30's. For many of them, nursing is a second career. They enter into a more acute clinical environment, where patients are sicker and more complex. Although schools have changed the curriculum, entry level grads have only basic skills - there is a great gap in the readiness of the individual.


How Hospitals Attract and Retain Nurses


Hospitals must now compete with one another to attract and retain nurses in a very competitive market. Southcoast's DeJesus notes that some hospitals are using preceptor programs to ease the transition of new graduates into high-paced, technologically complex clinical settings. Since new grads need more clinical experience, many hospitals create a professional development transition program. In addition to a week-long orientation, this program combines classroom time, and practical time with an experienced staff member for six months. This mentor relationship helps with a gradual introduction. Preceptors are trained and compensated. Mentors are often volunteers. It is a supportive transition that has received a very positive response.


Hospitals have had to be flexible in their approach to overcome the shortage. Use of travel nurses, for example, fills gaps whenever needed. Many nurses, particularly older nurses, often work per diem to keep working without the pressure of a full-time commitment. During a shortage in the early 80's, some Boston-area hospitals even recruited nurses from other countries, such as Ireland. Other approaches include sign-on bonuses worth several thousands of dollars, referral bonuses, and flexible hours. Flexibility of hours may allow nurses to work three 16-hour days, for example, with the next four days off. For women with children, a flexible schedule can be very important.


Southcoast's Debbie Pickup adds, Most hospitals are now focusing on retention. It is becoming critical to pay attention to all factors that are important to RNs in the clinical setting: having a voice and the ability to have some control over the practice of nursing. For example, a unit council meeting takes place on a regular basis and identifies issues and concerns to patient care. Years ago the nurse manager addressed this issue. Now TQM requires that more people are included in the problem solving and decision-making. Staff members are more involved in operational issues. Although some individuals still prefer that management fix all the problems, for the most part it works quite well.


Pickup added, The professional relationship between the nurses and physicians plays a factor on retention of nurses. If there is a good relationship, one that is consultative, respectful, and supportive, then job satisfaction is increased. If, on the other hand, the relationship is not positive, there is a higher turnover in the nursing staff.


Dean Munro strongly suggests that hospitals work closely with the nurses to determine their needs and establish their value to the organization. Perhaps the best ICU ever created was when nurses worked with the architects to design the unit. They designed a better unit simply by talking with the nurses.


Her advice to hospital management: Work with the nurses to see what is needed to improve job satisfaction. The number one concern is not always salary - it has to do with improving working conditions, being recognized for what they do, and obtaining the opportunity to learn new things. Nurses need to get a sense that they have done a good job for their patients. Listen to the nurses. Empower them. Make them part of the process. That process will be improved and so will the quality of patient care.

7 Tips to Real Estate Agent's Success: Tip #4 Establish Sales Goals

Sales goals are just as important in real estate as they are in any other business. Successful goal achievement begins with using valid criteria and understanding the linkage between sales goals and strategic planning.

Within your strategic plan for your real estate business, there should be a sales plan. This plan centers around specific sales goals to secure the result of converting those who have received your marketing message to an actual selling or listing client.

After establishing specific goals, then your challenge is to monitor these goals to ensure achievement. If you are new to this industry, it may take 6 months before the first sale. HINT: Use the W.H.Y. S.M.A.R.T. criteria for goal setting.

Many real estate agents have goals, but very few have integrated specific goal setting criteria into their goal planning, goal setting and goal achievement process. The S.M.A.R.T. criteria:

  • Specific
  • Measurable
  • Attainable
  • Realistically Set High
  • Target Date/Time Driven

are not new, but unfortunately, still not utilized as much as they should be.

One of the reasons for this is because the What?s In It For Me (WIIFM) or the W.H.Y. has not been included. All goals should be committed to Writing. When sales goals are written down, the intangible thought now has some substance and becomes more real. The paper can be not only actually seen, but also touched. Suddenly, the sales goal appears to be more concrete than just a wish or a dream.

Additionally, goal planning, setting and achievement is a process that should become a Habit of behavior. Weekly written grocery lists or the daily to do lists are habits that improve performance. Planning, setting and executing sales goals should become a habit that is consistently demonstrated on a weekly, monthly and yearly basis.

Finally, goals need to be Yours. Achieving goals for someone else usually are not successful because of the WIIFM. When the business sales goals can be translated into your specific goals, then you have greater ownership of the goals.

When the W.H.Y. S.M.A.R.T. criteria are infused into sales goals, successful goal achievement has been greatly increased. For example, using the industry average of 6% commission rate with 3% going to the listing broker and 3% going to the selling broker, the typical real estate agent averages 1.5% commission unless she or he listed and sold the property. If the sales goal is to earn $20,000 the first year, this means that the agent must achieve listings or sales of over $1.3 million. By the second year, the goal may have been increased to an income of $30,000 which translates into listings or sales of $2.0 million. By having the marketing research, the sales plan is data and market driven. Consequently, the agent can determine how many homes he or she needs to list or sell based upon the $1.3 or $2.0 million.

Sales goals are directly tied to the market plan within the strategic plan. Without goals, the real estate agent is embracing what I call the spray and praysales technique.

Spray your sales efforts on the wall and pray that they will stick giving you a sale.

In the last article, I pointed out when, as a real estate investor, doing a 1031 Exchange on the sale of a Real Estate Property may not be your best option.

So, let's assume you do want or need to sell a real estate investment, don't want to do an exchange, and don't want to pay a huge lump sum capital gains tax payment of 15-40% on your gains. Now is the time to see how a Private Annuity Trust can save you money.

It's important to know that you don't avoid paying your capital gains tax obligation, you just get to defer all payment for a while if you're under 70 years old, or you at least get to spread out the obligation over many years. The total of years can be your lifetime or a fixed number of years determined by you when you set up the trust.

So, how does that help you? Well, if someone were to offer you a 0% interest loan on let's say $300,000.00 for the next 30 years, and you only had to make minimum payments, would you jump at the chance? Most people sure would. Think of how you could invest that 300K so that you could enjoy the benefit of the interest it accrued. This is effectively what a Private Annuity Trust does for you. It allows you to keep most of your gains working to your advantage, while paying back the money owed to the IRS over a long period of time.

If you do not put a tax strategy in place and sell outright, not only do you owe capital gains tax, but you also owe depreciation recapture, which can be another 25-35% of your total depreciation taken over the ownership cycle of your investment.

And, you will avoid the possibility of the dreaded Alternative Minimum Tax trap. This is something else that may catch you by surprise when you least expect it triggered by your outright sale of property. This could mean having other legitimate tax deductions disqualified and a higher tax payment owed by you.

As you can see, it's definitely worth it to consult with an expert in Capital Gains Tax saving strategies before you make the decision to sell your real property.

The PAT can also work with the sale of a second home, vacation home, or even your primary residence. With these assets, a 1031 exchange is not an option.

In 1985, New York State implemented its first seat belt law, which made federally approved child safety seats mandatory for children under 4. While this law has saved countless lives, it is unfortunate that many children have been injured or have died as a result of flaws and defects in the child seats themselves.

One way to get this message to child seat manufacturers is to hold them liable for every injury a child receives as a result of a defective car seat. A Nursing Breast Is A Healthier Breast

In recent years we've learned a lot about how breastfeeding improves the health of babies. Formula feeding increases the risk of many types of diseases. Short term, formula fed babies are more likely to become ill with ear and respiratory infections and other illnesses. When they do get sick they are more seriously ill and much more likely to be hospitalized. Long term, formula fed infants are more likely to suffer from diabetes, obesity, asthma, Crohn's disease, and other ailments.

Interestingly, a lot of research points to numerous ways that breastfeeding impacts Mom's health. Let's look at just one of these findings.

A Lactating Breast is a Healthier Breast

Numerous studies have shown that breastfeeding reduces the risk of breast cancer. This is due in part to hormonal factors: nursing moms go without ovulating for longer periods of time than women who don't breastfeed. There is a connection between the number of times a woman has an ovulatory cycle in her lifetime and the likelihood of her contracting breast cancer. Breastfeeding also completes the normal fertility cycle of conception, pregnancy and lactation.

Additionally, the act of suckling itself plays a role. One native culture that traditionally only nursed on one breast had fewer incidences of cancer in the lactating breast. This makes perfect sense when you think about it: a body organ that is used the way it's designed to be used is healthier than tissue that isn't used. If you decided to sit in a wheelchair instead of using your legs to walk, what do you suppose would happen to your legs? They would eventually atrophy and become diseased.

Additionally, the longer a woman breastfeeds, the greater the protection offered against cancer. Scientists find that the more months a woman has spent nursing, the lower her risk of contracting breast cancer... great incentive to listen to the World Health Organization's advice to nurse for two years or more!

Interestingly, breastfeeding lowers the *babies* rate of breast cancer! While science is still trying to figure out exactly why this is so, one theory is that exposure to Mom's estrogen via breastmilk immunizes baby to estrogen later in life. Also, the immune factors present in mom's milk likely play a role in strengthening resistance to disease, even to a disease like cancer.

Who knows what else the scientific community will discover about the magic of mom's milk?

Educational Toys How They Evolved

The modern day busy parent tries to compensate for his or her lack of time for his or her children by investing a great deal on education. Thus, it is not a surprise how many of such parents move mountains just to provide their kids entertaining products that not only encourage play, but also instill discovery and learning.

Makers of toys worldwide recognize this growing trend and are, consequently, coming up with new and improved lines of children's educational toys and games almost every month. What was once limited only to specialty toy and game shops, educational toys and games are now a staple in every children's oriented stores around the world, even at general mass retailers, like Wal-Mart and K-Mart.

Statistics show that the sales of toys and games have declined over the years. However, educational toys have been on the rise, as more parents opt to purchase products that would give them the most value for their money, as compared to, say, buying Bratz dolls and Hot Wheels.

The record for educational toys was broken in the Holiday season of the year 2000, when toy maker LeapFrog's LeapPad Learning System electronic reading toy became the bestselling children's game of the time, helping the company boost its sales by a whopping 120 per cent!

LeapFrog's success paved the way for other major and small toy makers to come up with educational toys of their own. Jakks Pacific, under its Child Guidance brand, released its own line of children's educational toys and games following a deal with Baby Genius. Hasbro released its Baby Einstein line and unveiled its preschool units, namely the Baby Einstein Company and Playskool. These new toys encouraged children to dabble in art, music, different foreign and local languages, and even poetry.

The strong demand for educational toys and games for children has urged major retailers, like Toys R Us, to allocate shelves upon shelves for these kinds of toys. And because more and more households are transforming into two-income families, it is likely that the demand will grow further as parents seek products that would try to fill their absence during their children's formative learning years.

With the rise in demand, it won't be a surprise when the price tag that comes with these educational toys and games will also decrease as the years pass. Right now, these kinds of toys are still a little expensive (though it hasn't stopped most parents from buying them). In the future, due to the overwhelming interest, educational toys and games will be accessible to everyone.

Internet Telephony over Peer to Peer Networks


Peer to Peer technology (P2P) first came into focus through companies like Napster and Kazza, who developed file sharing applications that would allow users to share their own files, as well as search for and download files of other users on the network. Instead of relying on a centralized client server relationship, a peer to peer network gets its strength from each individual node, adding bandwidth and processing power with each new member for the good of the many.


Much like the Borg of the later Star Trek episodes, peer to peer can scale indefinately without the use of expensive central servers, and from a cost standpoint -resistance is futile!


Peer to peer Internet Telephony is, like Napster, a software application that you download on to your computer from a peer to peer VoIP service provider. The softeware, or soft phone as it is called, is free to download and calls to or from anyone on the network are free. The only hardware you need is a headset, or a microphone and speakers. Internet telephony headsets are cheap and come in USB or can plug directly into your sound cards.

For those with web cams, many providers allow you to make video calls to others on the network for free. Services offered with this technology go above and beyond the Telcos, with conference calls, call forwarding, instant messaging and chat - peer to peer Internet telephony literaly turns your computer into a telephone/vidiophone communications center.


Like the traditional VoIP providers, calls within the network are free worldwide, but calls to a PSTN number will usualy cost you if it is an option. You can in some cases, have different numbers in other locations so that people can call you from a land line even from other counties toll free. Even if you do have to pay to get on the PSTN, the rates are so much cheaper than a telco.


Just like the other forms of VoIP, developers have had some technological hurdles to overcome. Quality of Service, NATed firewalls, and centralized directories of members using a dynamic IP address are just a few. Also, as calls and instant messages are routed through the public Internet, encryption is a must for any user.


Internet Telephony in Ecommerce


Probably the best known company and indeed a pioneer of peer-to peer Internet telephony is Skype. Originaly founded by Niklas Zennstrom and Janus Friis, two of the innovators behind the P2P network Kazaa, Skype was bought by eBay in late 2005 for 2.6 billion dollars. With over 100 million users according to eBay, its safe to say that Skype is the industry leader in peer to peer Internet telephony. Ebay would like Skype to evolve into a customer service application, allowing potential buyers to communicate directly to Ecommerce enabled web sites online and in real time.

Another area where the peer to peer idea has taken off is the online gaming community.
